analyserons par la suite, il convient de rappeler que dans l\u2019hypoth\u00e8se o\u00f9 le salari\u00e9 n&#8217;exerce aucune fonction de repr\u00e9sentation du personnel et que le licenciement a \u00e9t\u00e9 d\u00e9clar\u00e9 abusif par les tribunaux espagnols il reviendra \u00e0 l&#8217;entreprise (et non au salari\u00e9) de choisir entre r\u00e9int\u00e9grer ce dernier ou lui verser les indemnit\u00e9s dues en cas de licenciement abusif.<!--moreComputation du d\u00e9lai d\u2019anciennet\u00e9 en Espagne en cas de licenciement abusif--><\/p>\n<p style=\"text-align: justify;\">A travers cet article, nous nous focaliserons sur le cas o\u00f9 l&#8217;entreprise d\u00e9cide de r\u00e9int\u00e9grer le salari\u00e9 dont le licenciement a \u00e9t\u00e9 jug\u00e9 irr\u00e9gulier.<\/p>\n<h2 style=\"text-align: justify;\"><strong><span style=\"color: #000080;\">Le temps \u00e9coul\u00e9 entre la notification du licenciement et l\u2019appr\u00e9ciation de sa l\u00e9galit\u00e9 par la juridiction sociale doit-il \u00eatre pris en compte dans le calcul de l&#8217;anciennet\u00e9 du salari\u00e9 ?<\/span><\/strong><\/h2>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Afin de r\u00e9pondre \u00e0 cette question, nous nous appuierons sur la jurisprudence de la 4\u00e8me chambre du Tribunal supr\u00eame rendue le 20 octobre 2015, qui, r\u00e9sum\u00e9e comme tel, vient pr\u00e9ciser :<\/p>\n<p style=\"text-align: justify;\">1) Que le licenciement a valeur ex\u00e9cutive et entra\u00eene n\u00e9cessairement la rupture des relations contractuelles, dans cette mesure, il ne peut \u00eatre admis que l&#8217;intervalle de temps entre la notification du licenciement et le jugement d\u00e9clarant son irr\u00e9gularit\u00e9, soit pris en compte pour calculer l&#8217;anciennet\u00e9 du salari\u00e9.<\/p>\n<p style=\"text-align: justify;\">2) Il n&#8217;y a qu&#8217;en cas de r\u00e9int\u00e9gration du salari\u00e9, que la relation de travail peut \u00eatre r\u00e9tablie, ainsi, le salari\u00e9 aura le droit a ce qu\u2019il soit tenu compte, en compl\u00e9ment de ses ann\u00e9es d&#8217;anciennet\u00e9, le temps \u00e9coul\u00e9 entre la notification de son licenciement et le jugement l&#8217;ayant d\u00e9clar\u00e9 irr\u00e9gulier.<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #000080;\"><strong>Qu&#8217;en est-il si le salari\u00e9 refuse de r\u00e9int\u00e9grer son poste ?<\/strong><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Dans ce cas, l&#8217;article 299 de la Loi R\u00e9gulatrice de la Juridiction Sociale (LRJS) dispose que le salari\u00e9 perdra de mani\u00e8re d\u00e9finitive, son droit de recouvrement des mensualit\u00e9s de salaire \u00e9chues depuis la date du jugement.<\/p>\n<p style=\"text-align: justify;\">En vertu de la jurisprudence mentionn\u00e9e ci-dessus, le temps \u00e9coul\u00e9 entre le jour du licenciement et le jour o\u00f9 le tribunal d\u00e9clare son irr\u00e9gularit\u00e9, ne sera pas comptabilis\u00e9 dans le calcul de l&#8217;anciennet\u00e9 du salari\u00e9.<\/p>\n<p><strong>Monika Bertram<\/strong><br \/>\n<a title=\"Mariscal
