Le contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e pour entrepreneurs a pour but d\u2019encourager les entrepreneurs et les PME \u00e0 offrir des contrats \u00e0 dur\u00e9e ind\u00e9termin\u00e9e aux employ\u00e9s avec une s\u00e9rie de bonus en termes de s\u00e9curit\u00e9 sociale, d\u2019incitations fiscales ainsi qu\u2019une p\u00e9riode d\u2019essai d\u2019un an.<!--moreLes modalit\u00e9s du contrat ind\u00e9fini pour entrepreneurs--><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #000080;\"><strong>Les caract\u00e9ristiques du contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e pour entrepreneurs<\/strong><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Le dispositif est maintenu jusqu\u2019\u00e0 ce que le taux de ch\u00f4mage en Espagne atteigne un niveau inf\u00e9rieur \u00e0 15%\u00a0:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Il concerne les entreprises de moins de 50 salari\u00e9s au moment de la signature du contrat<\/li>\n<li style=\"text-align: justify;\">Il est d\u2019une dur\u00e9e ind\u00e9termin\u00e9e<\/li>\n<li style=\"text-align: justify;\">Il peut \u00eatre \u00e0 temps plein ou \u00e0 temps partiel<\/li>\n<li style=\"text-align: justify;\">Une p\u00e9riode d\u2019essai d\u2019un an est pr\u00e9vue (non applicable si le salari\u00e9 a d\u00e9j\u00e0 r\u00e9alis\u00e9 ant\u00e9rieurement les m\u00eames fonctions dans l\u2019entreprise et sous les m\u00eames conditions d\u2019emploi).<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span style=\"color: #000080;\"><strong>Obligations pour l\u2019entreprise<\/strong><\/span><\/h2>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"text-align: justify;\">L\u2019entreprise doit employer le salari\u00e9 pendant au moins 3 ans et devra maintenir pendant au moins un an le m\u00eame niveau d\u2019emploi que celui du moment o\u00f9 d\u00e9bute la relation entre les parties. En cas de non-ex\u00e9cution de ces obligations l\u2019entreprise devra rembourser les avantages re\u00e7us<\/li>\n<li style=\"text-align: justify;\">Il n\u2019y a pas de non-ex\u00e9cution des obligations lorsque le contrat est r\u00e9sili\u00e9 par des raisons objectives ou suite \u00e0 un licenciement disciplinaire, et quand les licenciements sont r\u00e9guliers en cas de d\u00e9mission, d\u00e9c\u00e8s, retraite, incapacit\u00e9 totale et permanente, absolue ou pour grande invalidit\u00e9, pour cause d\u2019expiration du temps initialement pr\u00e9vu ou dans le cas de la r\u00e9alisation de l\u2019objet du contrat.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span style=\"color: #000080;\"><strong>Exclusions<\/strong><\/span><\/h2>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"text-align: justify;\">Une entreprise ayant proc\u00e9d\u00e9 \u00e0 des licenciements sans cause r\u00e9elle et s\u00e9rieuse dans les 6 mois pr\u00e9c\u00e9dant la signature du contrat ne peut recourir \u00e0 ce genre de contrats. La limite concerne les licenciements prenant effet apr\u00e8s l\u2019entr\u00e9e en vigueur de la loi du 3\/2012<\/li>\n<li style=\"text-align: justify;\">De plus, s\u2019appliquent les dispositions pr\u00e9vues dans la section premi\u00e8re du chapitre premier de la loi 43\/2006, \u00e0 l\u2019exception des articles 2.7 et 6.2.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span style=\"color: #000080;\"><strong>Avantages du contrat \u00e0 dur\u00e9e ind\u00e9finie pour entrepreneurs<\/strong><\/span><\/h2>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"text-align: justify;\">Possibilit\u00e9 de disposer d\u2019une<span class=\"cursiva-azul\"> p\u00e9riode d\u2019essai<\/span> d\u2019un an. Par la suite, une s\u00e9rie d\u2019incitations fiscales et de bonifications li\u00e9es au contrat sont pr\u00e9vues<\/li>\n<li style=\"text-align: justify;\"><span class=\"cursiva-azul\">Incitations fiscales\u00a0:<\/span> leur proportion d\u00e9pend de l\u2019\u00e2ge de l\u2019employ\u00e9 ou de sa situation ant\u00e9rieure (b\u00e9n\u00e9ficiaire des prestations ch\u00f4mage etc.)<\/li>\n<li style=\"text-align: justify;\"><span class=\"cursiva-azul\">Bonifications fiscales\u00a0:<\/span> les entreprises peuvent b\u00e9n\u00e9ficier de r\u00e9ductions sur les cotisations patronales \u00e0 la S\u00e9curit\u00e9 Sociales pendant 3 ans pour les ch\u00f4meurs inscrits dans la P\u00f4le Emploi. L\u2019ampleur des bonifications fiscales d\u00e9pendra de l\u2019\u00e2ge de l\u2019employ\u00e9. Ces bonifications pourront \u00eatre cumul\u00e9es avec d\u2019autres aides publiques pr\u00e9vues dans le m\u00eame but. Si le contrat est \u00e0 temps partiel, les bonifications sont calcul\u00e9es proportionnellement \u00e0 la dur\u00e9e de travail pr\u00e9vue dans le contrat.<\/li>\n<\/ul>\n<p><a title=\"Mariscal
