In practically all proceedings\u00a0in Spain<\/a> with\u00a0a foreign element\u00a0(basically\u00a0those\u00a0in which\u00a0one of the opponents\u00a0is a\u00a0national of a\u00a0non-Spanish-speaking\u00a0state) at least part of the\u00a0written evidence\u00a0to the\u00a0lawsuit is written in\u00a0a language other than Spanish (contracts, invoices,\u00a0correspondence, etc.).\u00a0In this sense,\u00a0Article 144.1\u00a0of the\u00a0Civil Procedure\u00a0Act (CPA) states that Any document worded in a language other than Spanish or, as appropriate, the official language of the Regional Authority in question shall have a translation of such document attached thereto<\/span>.<\/p>\n

By applying the\u00a0basic\u00a0procedural standard\u00a0under Article\u00a0265 of the\u00a0CPA, documentation\u00a0in a foreign language and its translation\u00a0in Spanish must accompany the lawsuit (or protest):\u00a0All claims and answers\u00a0shall be accompanied by:\u00a01) The\u00a0documents on which\u00a0the parties base\u00a0their right to the\u00a0judicial protection\u00a0they claim\u00a0(\u2026)<\/p>\n

However, in\u00a0court practice\u00a0it is surprisingly common that\u00a0the actor\u00a0– perhaps\u00a0due to the inexperience\u00a0of some\u00a0professionals in\u00a0proceedings with\u00a0a foreign element –\u00a0 \u00a0accompanies\u00a0his demand with documents\u00a0in another language\u00a0without\u00a0translating them into\u00a0Spanish.\u00a0It is possible\u00a0that under a\u00a0mistaken belief, the court\u00a0presumes \u2013\u00a0unless there is evidence to the contrary from the other party – that\u00a0the documents say what the demand indicates.<\/p>\n

This\u00a0is\u00a0unacceptable, not only because it is a flagrant violation of\u00a0the procedural norms\u00a0mentioned above,\u00a0but\u00a0also\u00a0because it may cause serious harm to the representation of the defendant who\u00a0cannot\u00a0understand\u00a0the language in which\u00a0the documents\u00a0are\u00a0written. It is true that\u00a0the defendant\u00a0could translate the untranslated\u00a0documents, but giving rise to this possibility\u00a0seems\u00a0not only illegal,\u00a0but also\u00a0unfair\u00a0under basic common sense.<\/p>\n

Despite this, some\u00a0courts allow\u00a0subsequent rectification\u00a0of\u00a0this bad\u00a0practice by allowing,\u00a0even after\u00a0the preliminary hearing (once\u00a0the defendant\u00a0challenges the\u00a0untranslated documents),\u00a0the other party\u00a0to provide the\u00a0translation\u00a0that was previously\u00a0nonexistent.\u00a0In this way,\u00a0the courts – as\u00a0is the case of\u00a0some Sections of the\u00a0Provincial Court\u00a0of\u00a0Madrid –\u00a0seem to care\u00a0more about not\u00a0harming the evidence of\u00a0the neglectful\u00a0plaintiff who\u00a0did not accompany\u00a0the translation\u00a0ab initio (from the beginning)\u00a0than the harm to the defendant who has\u00a0been held to answer the\u00a0demand\u00a0without having\u00a0the translation\u00a0in question.<\/p>\n

The incomprehensible\u00a0acceptance\u00a0of such courts\u00a0should not, however, favor\u00a0the defective\u00a0procedural\u00a0technique we\u00a0have spoken of. Any\u00a0diligent\u00a0lawyer involved in\u00a0a proceeding with\u00a0a foreign element\u00a0must not\u00a0forget to bring\u00a0proper translations with the\u00a0petition,\u00a0under penalty\u00a0of ineligibility\u00a0by the judge\u00a0and subsequent\u00a0ineffectiveness\u00a0of the documentary evidence in question,\u00a0at the risk of\u00a0losing the case\u00a0for lack of evidence.<\/p>\n

With more frequency, proceedings and\u00a0lawsuits\u00a0in Spain\u00a0are with opponents from non-Spanish-speaking\u00a0states.\u00a0In such cases, the law\u00a0in Spain\u00a0requires\u00a0the translation of\u00a0written documents supporting the claim.\u00a0Failure to do\u00a0so may\u00a0underestimate the\u00a0written evidence\u00a0and jeopardize the
