This article addresses the legal implementation of foreign hereditary titles in Spain<\/a>. \u00a0While this article presents a short introduction to the matter, it does not, however, replace a detailed legal consultation with a qualified lawyer.<\/p>\n

Private international law provides a number of optio<\/p>\n

ns for the regulation of foreign successions. \u00a0The subject of foreign successions \u00a0is a very complex matter because it attempts to balance multiple different legal systems.<\/p>\n

Two aspects that are common and indispensable to understanding this matter in the context of private international law include (1) when Spanish courts have jurisdiction, and (2) which law applies in cases of international successions.<\/p>\n

Jurisdiction of Spanish Courts<\/em><\/strong><\/span><\/h2>\n

Article 22 of Law 6\/1985 of July 1 of Judicial Power regulates when Spanish courts have jurisdiction. \u00a0This Article regulates, among other things, when Spanish courts are competent ones under general Spanish civil law.
\nArticle 22 states:<\/p>\n

1. Spanish courts have exclusive jurisdictional competence over:<\/span><\/em><\/p>\n

–\u00a0 Surface rights and the right to the subsoil in Spain;<\/span><\/em><\/p>\n

–\u00a0 The creation, activity, and nullity of companies or legal persons established in Spain;<\/span><\/em><\/p>\n

o\u00a0 The decisions of the organs of these companies or legal persons;<\/span><\/em><\/p>\n

– The inspection and management of official Spanish registries or directories;<\/span><\/em><\/p>\n

– The inspection and protection of patents and other rights that were notified or registered in Spain;<\/span><\/em><\/p>\n

– The implementation of foreign judgments and titles.<\/span><\/em><\/p>\n

2. Spanish courts also generally have jurisdiction when the parties have agreed upon it, either expressly or by implication, or when the defendant lives in Spain.<\/span><\/em><\/p>\n

3. If the question of jurisdiction is unclear under either of the above options, then Spanish courts will be the proper ones in the following cases:<\/span><\/em><\/p>\n

– To determine the protection of minors and disabled persons, provided their domiciles are in Spain;<\/span><\/em><\/p>\n

– To clarify legal relations between spouses, the annulment of marriages, separations, and divorces, provided that both spouses are residents of Spain the plaintiff is a Spanish citizen, or both parties are Spanish citizens and agree on the jurisdictional competence of Spain;<\/span><\/em><\/p>\n

– To determine custody issues if the child has a permanent place of residence in Spain \u00a0\u00a0the plaintiff is a Spanish citizen, or the plaintiff resides in Spain;<\/span><\/em><\/p>\n

– To determine matters of maintenance when the creditor resides in Spain;<\/span><\/em><\/p>\n

– \u00a0To adjudicate contractual claims provided that the contract was executed in Spain;<\/span><\/em><\/p>\n

– \u00a0To answer questions regarding successions when the testator\u2019s last place of residence was Spain or the testator possessed property in Spain.<\/span><\/em><\/p>\n

These three paragraphs enable us to glean the following information about succession in Spain:<\/p>\n

– Spanish courts have exclusive jurisdictional power over several specific types of cases. \u00a0Foreign judgments, then, are not recognised in these cases.<\/p>\n

– An individual can choose Spain as the appropriate jurisdiction either expressly or by implication. \u00a0In doing so, it is important to note that Article 55 of the Spanish Code of Civil Procedure \u00a0requires that the parties expressly agree on a court.<\/p>\n

– The power of the courts to hear succession cases may depend on the domicile of the defendant.<\/p>\n

– Spanish courts have jurisdictional power when the last domicile of the testator was in Spain or the testator had at least possessed property in Spain.<\/p>\n

Applicable Law<\/strong><\/em><\/span><\/h2>\n

After considering the question of jurisdiction, the question of which law applies follows.\u00a0 Private international law references Article 9, Paragraph VIII of the Spanish Civil Code.\u00a0 This Article states:<\/p>\n

Successions are governed by the law of the state to which the deceased last belonged – regardless of the location of the succession. \u00a0That law also governs the legal share. \u00a0Testamentary dispositions or contracts of inheritance are interpreted in the light of the country in which they were finalized, even if it is not that to which the deceased last belonged. \u00a0The rights of widowed spouses are governed by the law that governed the marriage.<\/span><\/em><\/p>\n

Considering the above, it follows that:<\/p>\n

The law of the state to which the deceased last belonged governs legal successions.\u00a0 This applies regardless of the country in which the succession is located.<\/p>\n

The law of the state in which the will was created governs testamentary successions.\u00a0 This law can be different from that of the nationality of the deceased. \u00a0The applicable regulations regarding the legal share originate in the law of the state to which the deceased last belonged.<\/p>\n

If a British citizen creates a will under British law (which does not use the legal share principle), becomes a Spanish citizen, and then passes away, the British citizen\u2019s will as a Spanish citizen would be governed by British law. \u00a0However, the Spanish regulations regarding the legal share, which are foreign to British law, would have to be applied to this case. \u00a0The consequence would be that a large part of the inheritance would not go to the inheritors named in the contract but to the beneficiary of the legal share.<\/p>\n

It would also be possible for another law to apply in the case where the deceased were married. \u00a0The law that governed the marriage governs the widowers\u2019 rights.. \u00a0Therefore, it is possible that three different national laws apply to a single succession case.<\/p>\n

Conclusion<\/strong><\/em><\/span><\/h2>\n

Therefore, succession cases with international ramifications can be extremely complex. \u00a0Both the determination of the appropriate jurisdiction and the applicable law imply a detailed analysis for every case.<\/p>\n
